1.    General
This user agreement is a part of and cannot be seen separate from all other user agreements as Holiday Dating and other services that our company will offer to our Members. For Holiday Dating conditions please refer to the terms and conditions in corresponding section, as extra part to our standard user terms.

DatingStars offers online services to our dear members so that we can offer the best that you can find in matchmaking and services related to this. If you’ve got any suggestions to our team, please feel free to contact at info@datingstars.com. We kindly request you to read these conditions carefully and make sure that you understand our terms of use of our systems that are valid for men’s section DatingStars.com register at our site.

Datingstars and other trade names used in our online systems are owned by WEB Industries International Ltd here after to called Datingstars.

2.    DatingStars.com
DatingStars.com is the Male section of our systems. Here we offer all services to let Men find the lady they are looking for. Due to our Free Elite membership that our service offers to serious male members, over 90% of Male members in our site succeed to find a lady. Since our service is based on the principle that if you can’t find her we help you with help of Free Elite status. We can offer you any assistance you need, as any system and company, we need to work with rules to guaranty our level of service. Our management team includes people who introduced online dating in several countries and have got experiences in Matchmaking for over 15 years. Please read our terms of use carefully, as they are made for your protection.

3.    Acceptance of User Agreement
All our agreements you can find electronic and published on our websites clearly for your information, to make sure that all the conditions between our organization and users is clearly written, and adding your content to our sites means that you have read and understood our terms. Please, do not hesitate at any time to contact us through our contact form if any of these terms are not clear to you. Adding your profile, information, content to our website means that you accept them and confirm that you have read our terms and conditions. Our terms can be printed also in PDF format, in a download format at the top and end of this page and conditions as “printable copy”. Access to our website makes you accept our terms and conditions, as well as accept our disclaimer and privacy policy.


4.    Applicable Law                
Due to the international operation, if there is any dispute arising out of our service or websites, you accept that Dutch Law in The Netherlands EEC is applicable.

5.    Type of Agreement                        
This agreement is applied to all our services and sites, some parts can be subject to partial agreements, for example Holiday Dating, but our main agreement covers all partial agreements and in all cases is binding for all parties.

6.    Exchange of personal information            
You agree to take responsibility for confidential use of password and user names, and shall inform our organization immediately if any unauthorized use is done with your password and Username. We strongly advise you for online dating activity to create a separate password from any you possible use for financial purposes, such as bank accounts login, credit cards, Pay pal or other strictly confidential and fraud sensitive. You must make extra caution when you access to your account form public computers due to login recording and cookies. DatingStars will not accept any responsibility of unauthorized use of your account in our systems. Please make sure that you avoid any risk e.g., that other users can login to your account. For more information and for protection from fraud, several sites on internet can provide you with useful information.

7.    Warning for Male Members                
Our female members are all registered through local offices and need to identify themselves. That’s why if there is fraud we can localize it more easily comparing to online dating sites. This makes sites like our system to have the lowest level of online dating fraud in the industry, called “introduction dating”.  You must understand that scamming is frequently done by fake letters not coming from females but created by interpreters or agencies that try to make money on you. We do only allow Female members to introduce themselves with standard correspondence, we check correspondence very strictly and if we find out that any female member sent letters out that not created by herself and finally if needed translated, she will be excluded from the site the same day, we strongly request you to announce any such situation to repot that has our highest priority!

7.1.    Money
If any request for support in terms of money will reach you, direct report this to our staff. In our system it is strictly forbidden for females to request any financial support. 7.2      Behavior
Communicating with other members, staff or representatives, you may not to be abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive. If we feel that your behavior towards any of our customer care representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership, and you will not be entitled to any refund of unused subscription fees.

8.    Eligibility of Age and use of our system    
You must be at least eighteen (18) years and single / unmarried or separated from your spouse to register as a member of our services. In countries where the law for using our type of service is 21 we follow the regulations strictly.

9.    Pricing - members
You can register totally free to become our member, and use parts of the sites. Male members can purchase credits, call minutes or other facilities that we offer for making use of advanced parts of the site and service in general. Prices and purchase can be found in the purchase section of the sites. Our database manager check inactive profiles, profiles that have financial balance can be put offline if it is not used for longer period as 90 days. We can keep the right to remove profiles inactive for more than 180 days from the system, including any financial balance that will not be refunded if profiles are inactive for more than 180 days to protect the quality of our system and services.
                
10.    Billing and charges     
We offer a large scale of payments methods, more than 99% of our payments are made online. In our system you can make your choice of preferred payment service and method, as well as settings for your payment methods are available. We keep the right to correct payment mistakes. If you make use of recurring payments, you agree for this and our system makes you understand by confirmation you accept to accept recurring payments. We follow several security procedures for online payments, so if your payment is not accepted online it can be due to restriction of the region (high credit card fraud region), IP block, or other security rules that we follow.

Bonus codes and other free trials. Any bonus code or other promotion that we provide must be used within the specified time of the trial, if there is a date limitations on the compliment card or bonus code that you received.

11.    Refund and Chargeback
All functionality and services at the site are offered as it’s presented on the site, DatingStars and its companies cannot be responsible for actions and behavior of its members, accept that we can decide to exclude them from the site and services if they don’t respect the rules. We can only ensure you that your letter or messages in live chat will be delivered through our system, if the member decides not to answer, then the service and order is completed and this responsibility is between both members. Delivery of gifts sent to members can only be confirmed by sending a photo to the sender, gifts cannot lead to love, just the other member that receives the gift can respect and appreciate it, but how this member will show her gratitude is completely depend upon her, this relates to relationship between members. Chargeback made based on refund for services purchased and delivered are completely for responsibility of the member. If the member does not understand the system, he can always request our staff for assistance. If member uses the system without request, he accepts that he understands the system and consequences as well. Such chargeback fees as administration fees, legal assistance, will be 100% claimed to the member. Credit card and payment methods: member accepts that he will only use payment methods for where he is legally responsible and authorized.

12.    Correspondence                         
Correspondence in our system means letters received and opened from members with notification. Letter received from members will show a small note before opening, when opening the letter it will show a notification for the cost for that transaction. By opening the letter member accepts this cost. Sending a letter works the same, when the letter is completed and member wants to send it to the other member, it will show a notification with the cost of sending for this letter, “submit” this letter means member accept this cost. Sent Letters received by members, means the letters is delivered. DatingStars cannot be responsible for any behavior of the member receiving the letter. It’s up to members to decide if they answer this letter or not. It’s not allowed to mention phone numbers, E-mail addresses in correspondence, for personal information make please use of the “Call her” service, Elite members can also contact their personal assistant, see “Elite membership” section.


13.    Holiday Dating    
Here we give you some information about how it works, what’s included in your trip and what not! When you decide to book your holiday together, our team will start with processing your request for a quote. Before you decide to request a Quote, please ask your partner, if she is available during this period!

Once she agreed to join you on the holiday and you confirmed the date she can join you, it’s time to select your accommodation. After our team receives your request for the “Quote” price offer, we will check the availability of the accommodation. If this is occupied during this time, we will offer you a similar accommodation based on our experience.

As travel and booking agents we act only as Agents for the Principals actually providing relevant services, and with whom your contract will be concluded. We shall not be liable for any act or default on the part of such a Principal or its agents or employees. All holidays shown are subject to availability.

Nevertheless, the service that DatingStars offers you implies reconfirming your booking and details, but we cannot replace you! You have to make sure that “she” is the one that you would like to join and invite for your wonderful holiday together! Make sure that you got enough contact by correspondence and phone before you decide to travel, as this is the key to success for your days together.

13.1.    Your Holiday Contract
When you make a booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract will exist as soon as the booking is confirmed in our computer system. This contract is made on the terms of these booking conditions, which are governed by Dutch law, and are under the jurisdiction of the Dutch Courts.

DatingStars acts at all times as a booking agent on behalf of the supplier(s) involved in your holiday booking. As a booking agent, the company's role is to ensure that all travel components/services booked correspond with what has been agreed with you at the time of booking. In the case of those components/services deviating from what has been agreed due to the supplier(s') inability to honour the contract, then DatingStars will open a communication dialogue between the relevant supplier(s) and the customer and will not be liable for any compensation claims. In this context, DatingStars cannot be responsible for any changes imposed by the suppliers nor can be considered liable for any omissions/mistakes, unless the latter occur due to our negligence. Ultimately, the customer will enter into a trading relationship with DatingStars, which will be restricted solely to the above mentioned role of the company as a booking agent, as well as with the various suppliers involved who will have the responsibility to provide in full the services/products advertised at the time of booking.

13.2.    Payments
Bookings with transfers, low cost and scheduled suppliers need to be paid in full at the time of booking and will be non-refundable. Bookings are confirmed when the total amount of the invoice / order confirmation has been received, for the DatingStars due to legal issues only bank transfers to our legal bank account written on the confirmation are accepted.

13.3.    Changes and Cancellations
Bookings made with low cost carriers are subject to 100% cancellation charges from the moment they are booked. Refundable tickets booked under these conditions will be refundable for what the airlines pays to DatingStars, transfers / hotels are also subject to 100% cancellation charge from the moment they are booked unless the hotel management accepts different. Other amendments or changes to your booking must be received in writing from the lead named passenger. Charges may be levied by the tour operator or by your chosen suppliers, for which you will be advised at the time of the amendment. In addition, DatingStars reserves the right to apply additional charges in the event of cancellations or amendments. The latter will have an immediate effect from the moment you place a booking through us. Please note that any incorrect information in the documentation received from us must be brought to the attention of the Administration Department of DatingStars within seven days of the date of issue of the received documents. We will not accept responsibility if you neglect to check the validity of all the information provided after the time period specified above. Failure to draw the correct information to our attention will impose the following charges, in addition to the tour operator's terms and conditions.

13.4.    Insurance
We recommend that all passengers are adequately insured before travelling abroad. The latter is usually a prerequisite for most tour operators, who reserve the right to deny travel when proof of insurance cannot be provided. DatingStars includes a standard medical insurance for the Female Guest but cannot take any responsibility besides assistance if needed with the local insurance company.

13.5.    Flights, time and tickets
Flight times and prices shown are provisional and may be subject to change, as per the tour operators' booking conditions. Any changes in flight prices from the time of search will be indicated on the booking page before you make payment. For flight only reservation, please reconfirm your flight time 48 hours prior to departure as per the tour operator's/airline's instructions. This applies to both your outbound and inbound journey, as changes to flight times may occur while you are abroad. Tickets are generally issued by the tour operator between ten and fourteen days prior to departure, however they still reserve the right to issue documents at the airport. Please contact us one week prior to your departure if you have not received any travel documents. Upon booking you are subject to the airline supplier's terms and conditions. Further details about luggage usually you can find at your ticket info.

13.6.    Passports, visas and health issues
Passengers must be in possession of a valid passports, necessary visa(s) and we strongly advise to have your medical insurance with you. In case if passengers are refused in entry by any immigration or other authority, all repatriation costs are to be borne by the passenger.

For the locations we have selected for the moment, there are NO special visa requirements, this means that Female Guest can buy/get her Visa at the local airport upon arrival.

All rates on DatingStars are for passengers only. It is very important that you carry the right documentation with you, such as your passport or equivalent ID card. DatingStars cannot be responsible for any problems during the check-in, if these documents are not coherent with the restrictions mentioned.

At the time of booking it is the customer's responsibility to advise us any special mobility requirements for flights, transfers or hotels. Please note however, these cannot be guaranteed.
If you need any more information regarding passports, please check the Identity and Passport Service, or look at your Embassy you find under information of the local Embassies from your country and final travel destination.

13.7.    Customer Service
We hope that your travel arrangements run as smoothly as possible, and that you will enjoy your holidays. However, if you have a complaint while you are in the resort, you must first report it immediately to the local representative of the supplier or to the accommodation management. If the problem cannot be resolved on the spot, you should make a written complaint to the supplier's representative in the resort and report the matter in writing to DatingStars within 14 days from your return. Please note that you should allow us 28 days, so that all issues raised can be concluded and resolved.

13.8.    Force Majeure
We will not make compensation payments for any cancellation/changes caused as a result 'Force Majeure'. Force Majeure means any inability by us to perform our contractual obligations resulting from any cause or reason whatsoever beyond our reasonable control. This includes, but is not limited, to: acts of war (whether war is declared or not), the threat of war, riots, civil disturbances, industrial disputes, terrorist activity, natural disasters, fire, technical problems to transport, airline failure, closure or disruption to airspace or airport.

13.9.    Data Protection Policy
We have taken every possible measure to ensure the confidentiality of your personal information. However, some of the details shall be given to the suppliers, associated with your holidays, such as your tour operator, airline, hotel, transport company, insurance provider, etc. The information may also be provided to security or credit checking companies, public authorities, such as customs/immigration, if required by them, or as required by law. Please note, that once your information is passed onto the suppliers associated with your holiday, the information becomes subject to their data protection policy.

13.10.    What if the holiday did not work out as planned?
We and you as well of course hope that this possibly is the beginning of a new episode in your life, but it can happen that your holiday and meeting work out in different way. Still our professionals are always ready to help both of you, in last case when the situation ends that you would not like to stay together, we offer your woman the possibility to be transferred to one of our controlled small local hotels till the date of her flight back. By accepting and booking our service you accept in any circumstances to act like a gentleman, and we ask you to pay for her cost during the days left, this is the guarantee that DatingStars administration gives to your lady. This is normally not more than a few days, local hotel costs between 35 and 75 euro per night, depending on the season. This is exceptional, but we have to bring this under your attention.

User Agreement governs the use of the DatingStars website!
When placing a booking, you guarantee that the details you have supplied are correct, including passenger names, dates, etc. If there are changes to the details supplied, it will be your responsibility to contact us and request changes. Please use our DatingStars Admin Mail or the mail account of your Hostess that organized your documents.

DatingStars will put its best endeavours to find and rectify any errors and omission as quickly as possible. However, because of the sophisticated technology required, there may be times when obvious errors occur, such as the price or some other detail displayed being incorrect. In this case DatingStars shall reserve the right to cancel that contract and the customer will not have any liability to this regard.
Our booking platform may accept unrealistic bookings without objecting any further to the user's judgement, and in this case we reserve the right to refuse any refunds in respect to those products purchased.

DatingStars does not warranty that the website is free from infection by viruses or any other software with contaminating or destructive properties. You can understand that our software and systems are running in modern data centra with the latest fireewall and virus protection.

When a visitor chooses to pay offline, then he undertakes that the product(s) selected may not be any longer available. Confirmation of order in this case is made when we receive full payment of the product(s) selected.

13.11.    What if my lady will not come and show up?
All ladies at our site are personal checked and registered by our local offices. All of them has to come to personal meeting, especially when they admit Holiday Dating and accept your invitation, they must come for a personal interview, also before she accepts any invitation she receives a brochure in her local language about our “Holiday Dating service” and printout of these Terms and Conditions.
We would not like to sell you any trip if we are not ourselves 100% convinced that the woman has real intentions to stay with you, this is the GUARANTY we can give you. But as well you just understand that this kind of holidays are special and you always have a risk in the last moment that some reasons comes up why she can’t travel, this risk you have to calculate and DatingStars cannot accept any responsibility for this. If we feel that your choice is not right we tell you, and it’s up to you if you book than!

From our experience we can say that 99% of the women after feedback of our back office team really want to travel and meet the man they possible dream about to start a new life, but you have to be most convinced she come for YOU, this is the part “YOU” have to clear out! We can only help you by offering the best services

13.12.    What is included in my trip and what is not?
You accommodation, depending on booking one/two rooms, all travel expenses from your Lady, and depend on accommodation - foods and drinks (if mentioned) in all inclusive resorts, standard insurance for your Lady, her transfer from and to the airport. If agreed in the order confirmation - passport fee or travel money for your Lady (as mentioned in your quote). Not included is your Ticket, insurances and airport transfer, if not requested by your booking. If you requested that DatingStars takes care about this and paid for this, of course this is as well included into your trip.

13.13.    Male member trip.
The reason why we don’t include male’s airlines ticket is that most of our members fly from different places, or would like to use preferred airlines, or for any other reason. This we leave up to you, you’re free to decide and book your trip. If you want DatingStars to book your ticket and transfer, please fill this in your booking and our team will offer this in your Holiday Dating trip.
                    
14.    Elite membership
You can reach elite membership just by using the services on the site and earning points. Normally Elite service is developed for members who did not succeed in the period of using the site, than the system automatically gives you the Elite status free of extra charges. Benefits of Elite members can be found at the site information. Elite members have special access to the personal assistant. Elite members accept as all other members to respect the terms and conditions of our system and sites. Members who did not reach the elite status, can as well get this by paying the difference between free eared points /value and the final price that the Elite membership costs. Elite memberships or points value are just for indication, and cannot be used in any way except of receiving the Elite status.
Once the Elite status is reached the counter automatic stops and member status changed in “approved Elite member”. Elite card, points or value are NON refundable. Why Elite members can request for personal contact details faster: Elite members are regular users of our sites and services, and we’ve got more details and information of Elite members than we do have from regular members, and in this case we can provide more information to ladies about the partner she has contact with, this works both sides. As long as we can inform you about her, we inform her about you - “equal rights”.

15.    Gifts and flowers delivery    
Gift service means E-commerce facility and delivery service, offered by our company. After ordering, our team makes all efforts to deliver your order as soon as possible, if items are at stock/available. If you need your gift to be delivered on a special date, please take minimum 7 working days to get your gift delivered on time. Usually it takes maximum 7 days from the moment gifts are ordered till the delivery. In normal situations it goes faster, but always keep in mind that we work in a very large region. Member accepts that ordered gifts are not refundable unless they are not on stock, than we refund the amount or advise you to select other present. As proof of the delivery, our service makes a photo at the moment when the lady received the gift and sends it to you by mail.

16.    Call her service                        
“Call her” service is provided as introduction between members with direct communication through our call centre, which offers translation service during the call. Calls take place in a 3 ways system, and as we used to provide the best value for money concept, high speed data connections for part of our call operation. DatingStars and its companies cannot take responsibility for poor connections, if this happens we book your call free of charge at other time. Male members got the right to request lady’s personal information during the phone call. The operator will ask if she can give this information according IMBRA rules, and if the Female member accepts, the male member will receive her personal details. If the lady refuses, this is her right, and we cannot accept any responsibility for her final decision. Some men call a lady directly without any correspondence; no wonder if a lady who receives a phone call from unknown person refuses to give her personal details, as well our organization. We strongly request you to have a minimum of 3-5 letters with a lady before calling her.

17.    Online communication – Live/video Chat
Live chat in DatingStars.com is built to create your relation and to learn your partner more closely. That’s why female member “cannot” invite you to chat, as ladies they chat free of charge. Only ladies who you’ve got previous correspondence with, or those who you added to your chat list (favorite list), or those whom you invited to chat with you have access to open a chat with you. Our live chat has multiple session access, this means you can open several chat sessions with different ladies at the same time. Live chat is built on the latest platform, and when your partner has access to a web camera, you can also see each other. For ladies it is not allowed to transfer personal information during live chat according to privacy IMBRA Policy. We keep the right to exclude from the chat service those male members who request personal information. If you like to receive her personal information, please use the Call her service, or if you got the Elite status contact your personal Elite assistant. As we do all to avoid any unpleasant situation for any of our members.

18.    Security and communication    
Congratulations, you selected one of the most safe foreign dating sites in the world, but we need to make you understand that we don’t control the behavior of our members, and no dating site in the world can take responsibility for that other than to exclude them immediately from the site, if the behavior is not in line with our rules and conditions. Never handover personal details, financial information or other details that can lead to misunderstandings, this count’s as well for our ladies, as long members follow and respect our conditions and rules you can avoid misunderstandings or disappointments during your search.

19.    Mailing list Opt in - out                
Our sites and systems send automatic mails, some are for advertising promotional purposes and these mails are sent from our CRM (customer relation management) system. You can recognize them, as under the mail you find the Opt out function. Please note, that if you Opt-out from the mailing list, you do not receive special offers and other information about our services. Mails sent from your account and directly from the dating site, do not have this Opt-out functionality, since these mails are part of your membership and as long your membership is active you will receive these mails. In our system you’ve got the mailing list function, where you can inform the system what kind of mails you would like to receive or exclude from receiving. By adding your profile to DatingStars.com you accept that we send you these mails to the mail inbox you use for the system. If you do not want to be disturbed in your business account, please create extra mail account free in any known mail system separately for your dating correspondence to not lose any communication, and as well keep your mails separately from your daily business or other private mails.

20.    Adding and Changing information at our sites        
You accept to take full responsibility for information that you place / post on DatingStars.com websites or documents / services. You guarantee us that you will not post – transmit any: illegal, offensive, discriminative, misleading, false or abusive materials or information at our sites or services. If you feel or recognize other members do this, you need to promptly inform our staff to check this information and possible remove this information or member from our site(s). You accept and agree that our database manager can refuse / remove any information / content posted by you, if this is not in line with our regulations without discussion. Posting personal info as e-mails, incorrect photos can make us delay your approval process for your profile. Please note that if your profile is active public, changing information in some sections can automatically cause your profile to be offline, because it needs to be checked and approved. Erotic pictures are not allowed on our sites. You agree that your content can be used in affiliate partner sites and will be used as links to your profile to create interest and traffic to your profile. You agree not to post any photo materials other than from yourself and that materials or brands related to your photo do not have any copyrights branded that can lead to our responsibility. Any photo posted and approved by us is only to protect our systems and not to legalize any copyright or trademarks.

21.    Stalking        
You accept to respect the privacy of any other members in accordance with purpose that the system was made for - to create contact and relationship. If a member shows that he/she is not interested in you, it’s not allowed to insist on correspondence. Correspondence and contact must lead to friendship and possible relationship with respect to these rules.

22.    What is prohibited on our sites
It’s strictly forbidden to upload your profile or make use of our service if you are convicted of aggressive behavior or arrested and / or convicted for a sexual offense.
